Who you are buying from
MicMyDay is sold through Polar, who act as the merchant of record. Polar is the seller for the purposes of your purchase, and their terms govern payment, invoicing, VAT and refunds. Your contract for the sale is with Polar.
The software itself is licensed to you by the provider named in the imprint, under the terms below.
Your licence
A purchase grants you a non-exclusive, non-transferable licence to install and use MicMyDay for as long as you like, including all future versions covered by your purchase.
A licence key may be activated on a limited number of Macs, shown when you activate. You can release a Mac at any time from the app's licence settings, or from your account with Polar, and use that activation elsewhere.
You may not resell, sublicense or redistribute your licence key, or share it outside your own household or organisation.
The free trial
MicMyDay can be used without payment for a 14-day trial period. Nothing is limited or watermarked during the trial. When it ends, dictation stops until a licence key is entered. Your settings, history and downloaded models remain untouched.
Source code and open source
MicMyDay's source code is published under the GNU General Public License version 3, so that anyone can inspect what the app does. That publication is an invitation to audit the code, and the GPL governs the source code only.
The application you download and pay for is a separate, proprietary distribution licensed to you under these terms. Buying a licence does not place any restriction on your rights under the GPL with respect to the published source.
MicMyDay includes third-party open source components. Their licences are listed on the licences page and inside the app.
Data
Dictation is processed on your Mac. Checking a licence key sends the key and your IP address to Polar. What is processed, and on what legal basis, is set out in the privacy policy.
Refunds
Refunds are handled by Polar as merchant of record, under their refund policy and any statutory right of withdrawal that applies to you as a consumer. Because a trial is available before purchase, we encourage you to use it. [Decide whether to offer a money-back guarantee beyond the statutory minimum, and state the period here.]
Warranty and liability
MicMyDay is provided as it is. Speech recognition is imperfect by nature and its output should be checked before it is relied upon. [This section must be reviewed by a lawyer: a blanket disclaimer is not enforceable against consumers in Germany, and statutory liability for defects, intent and gross negligence cannot be excluded.]
Changes to these terms
These terms may change for future purchases. The version that applies to you is the one published at the time of your purchase.
Governing law
German law applies. [Confirm the wording with a lawyer: mandatory consumer protections in the buyer's country of residence continue to apply regardless of a choice of law clause.]
